Terms of Service

1. Summary

These Terms of Service ("Terms") govern your use of SongGift. By creating an account, purchasing credits, or generating a song you agree to these Terms. We've tried to write them in plain language. This page is general information and not legal advice.

2. Who we are

SongGift ("we", "us") operates this website and the custom song generation service. You can reach us at support@songgift.app.

3. Eligibility

You must be at least 13 years old to use SongGift. If you are under the age of majority in your country (usually 18), you must have a parent or guardian's permission to use the service and to make any purchase. By purchasing a song for another person you represent that you have the authority to do so and that the recipient consents to receiving it.

4. Your account

You are responsible for keeping your account credentials secure and for any activity that happens under your account. Let us know at support@songgift.app if you believe your account has been accessed without your permission. One account per person, please.

5. Credits and purchases

Song generation is powered by credits, purchased in one-time packages via Stripe in US dollars. Current packages are the Standard pack ($9, 120 credits, up to about 20 songs) and the Extended pack ($29, 480 credits, up to about 80 songs). Each song generation costs 6 credits. Credits are valid for one year from the date of purchase, are non-transferable, and have no cash value. Prices and packages may change over time; changes will not affect credits you have already purchased.

6. Refunds

Because songs are generated on demand by AI, all purchases are final except in the following case: if we fail to deliver a song you paid for due to an error on our side, we will re-credit your account or issue a refund of the credits used. Disliking the creative output of a generation is not grounds for a refund — AI outputs are inherently varied and you can try again with more detail. If you believe your order failed on our side, contact support@songgift.app within 14 days of the order.

7. Creating songs

You provide the prompt information (occasion, mood, style, memory notes, dedication) and we generate lyrics and music using AI providers. Songs are typically ready in two to three minutes, but delivery is best-effort and not guaranteed. Occasional failures happen; we retry automatically and will re-credit you if we cannot deliver at all.

8. Acceptable use

You must not submit prompts that:

• Infringe copyright or impersonate a named artist (for example, "in the style of [real artist]" or asking the song to sound exactly like a specific performer).
• Target real people for harassment, defamation, doxxing, or sexual content without their consent.
• Promote violence, self-harm, hate, terrorism, or extremism.
• Sexualise minors in any way, or depict child sexual abuse material.
• Violate any applicable law or the rights of others.
• Attempt to reverse-engineer the service, scrape training data, overwhelm our infrastructure, or bypass our moderation systems.

9. Moderation and removal

We use automated moderation and human review to enforce section 8. We may refuse, cancel, or remove any request that violates these Terms. Orders that are flagged for serious policy violations may forfeit the credits used, without a refund.

10. The content you give us

When you submit a prompt, memory notes, or a dedication, you grant us a limited, worldwide, royalty-free licence to use those inputs solely to generate and deliver your song and to operate the service (including backups, moderation, and internal logs). You remain the author of your inputs.

11. Your rights to the generated song

Subject to your compliance with these Terms, we grant you a worldwide, non-exclusive, non-transferable, personal-use licence to play, download, share, and gift the songs you generate. This licence is for personal, non-commercial use only. Without separate written permission from us, you may not:

• Use the song in advertising or sponsored content.
• Sell the song, license it, or include it in a product or service offered for money.
• Use the song as the soundtrack in a monetised video, film, game, or app.
• Claim authorship of the song as if you had written it yourself.

Generated songs are produced by third-party AI providers and may also be subject to those providers' terms. We make no warranty that any generated song is free from similarities to other works.

12. Our intellectual property

The SongGift name, logo, website design, and copy belong to us. Nothing in these Terms gives you rights to our brand or site beyond what is necessary to use the service as intended.

13. Third-party services

SongGift relies on third-party providers including Stripe (payments), Supabase (hosting, database, storage, and authentication), Resend (transactional email), PostHog (analytics, only if you consent), OpenAI (lyric generation), and Kie/Suno (music generation). Using SongGift means your data flows through these providers and is subject to their terms and privacy practices. Our Privacy Policy describes this in more detail.

14. Suspension and termination

You can stop using SongGift at any time and request account deletion via support@songgift.app. We may suspend or terminate accounts that breach these Terms, abuse the service, or engage in fraudulent activity. Unused credits on an account terminated for cause may be forfeit.

15. Disclaimers

The service is provided "as is" and "as available", without warranty of any kind. We do not warrant that the service will be uninterrupted or error-free, that any generated song will meet your expectations, or that outputs will be free of errors, similarities to existing works, or offensive content. AI generation is inherently unpredictable.

16. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability to you for any claim arising out of or related to the service is limited to the total amount you paid us in the twelve months before the claim arose. We are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits or data.

17. Indemnity

You agree to defend and indemnify us against any third-party claim arising from the prompts you submit, your use of generated songs, or your breach of these Terms.

18. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top. If the changes are material we will make reasonable efforts to notify you. Your continued use of the service after the changes take effect means you accept the updated Terms.

19. Governing law and disputes

These Terms are governed by applicable law. Any dispute arising out of or related to these Terms or the service will be resolved in the courts of competent jurisdiction. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
